BY ESTABLISHING AN ACCOUNT WITH, OR BY USING ELAKE.IO WEBSITE(S), YOU EXPRESSLY AGREE TO THE FOLLOWING TERMS AND CONDITIONS, WHICH MAY BE AMENDED FROM TIME TO TIME AND AT ANY TIME BY POSTING THE AMENDED TERMS ON ELAKE.IO WEBSITE(S). ANY AMENDED TERMS SHALL AUTOMATICALLY BECOME EFFECTIVE IMMEDIATELY UPON POSTING.

eLake reserves the right to terminate or suspend your use of any eLake.io Website and Service if you do not comply with this Agreement or any of eLake’s policies or procedures, or for any other reason we may determine, at our sole discretion.

These terms govern any Offer you receive to sell your Product to or through eLake.io website(s). These terms shall also govern your use of any eLake.io website (“eLake Website”), the Services and any and all applications included therein, and any supplemental terms or policies that accompany a specific transaction, feature, or application, collectively, make up an agreement between you and eLake (“Agreement”). You acknowledge that this Agreement is in an electronic format and has the same force, validity, and effect as an agreement made in writing. In this Agreement, the term “you” or “your” means an individual or entity exercising rights under this Agreement.

In order to complete a Trade-In or to complete any other transaction with eLake, you must:

  • (a) provide accurate, true, and up-to-date account information about yourself and any Product you submit to us;
  • (b) comply with all terms and conditions of this Agreement;
  • (c) comply with all applicable laws and regulations, including import and export laws;
  • (d) transact on behalf of yourself and not on behalf of others;
  • (e) be at least eighteen (18) years of age and have the legal competency and capacity to enter into legally binding agreements; and
  • (f) be able to convey clear and unencumbered title and interest in any Product that you send to us.

In order to receive payments for any Products in connection with a Trade-In, you must provide us with current and accurate contact and payment information. This includes a valid email address, postal address, first and last name, and preferred payment method (e.g., PayPal™️, check, or other supported options). eLake may issue payment at its sole discretion using the selected method. You are responsible for ensuring your information is accurate to avoid delays or lost payments.

eLake shall not be responsible for communication errors caused by inaccurate or outdated contact information. If you fail to provide correct information, (a) eLake shall not be responsible for any Trade-In payments sent to an incorrect address, and (b) any unclaimed funds may be turned over to governmental authorities in accordance with Michigan’s Unclaimed Property Act (Public Act 29 of 1995).

State Sales Tax will apply to all items shipped to states and jurisdictions in which we are legally obligated to collect sales tax.

Shipping is free domestically in the United States. The choice of shipping provider shall be at eLake’s sole discretion. If you choose to purchase additional insurance coverage during checkout, it is your responsibility to ensure proper packaging. We are not liable for damage due to inadequate packaging.

Device condition categories are used to assess value. Products must match one of the following categories as described during the Offer process:

  • New: Sealed in original box with all accessories.
  • Flawless: Like-new, 100% functional, minimal signs of use.
  • Good: Light wear, fully functional.
  • Fair: Heavy wear but functional.
  • Broken: Has functional issues, missing components, or damage.

If the condition or model of your device does not match your submission, we may revise your offer. You will have three (3) business days to accept the revised Offer. If you do not respond, you will be deemed to have accepted the new Offer, and payment will be processed.

Offers are valid for twenty-one (21) days. If your device is received after this period, it will be re-evaluated at the current market rate.

Devices must be free of any software or hardware locks. This includes, but is not limited to, Activation Lock, iCloud, Google, FRP, Samsung, and MDM/corporate locks. Locked devices will not be accepted, and return shipping fees may apply.

Devices reported lost, stolen, or blacklisted will not be purchased. Such items may be reported to authorities and retained or recycled without compensation.

eLake reserves the right to reject any Product that does not match the submitted details, is tampered with, or is received in an unacceptable condition.

You are solely responsible for removing all personal data and accounts from your devices. By submitting your device to eLake, you release us from any liability regarding any data left on the device.

Title to your Product passes to eLake upon acceptance of the Offer. If the device is returned to you due to rejection or non-acceptance, you retain ownership.

You may track the status of your transaction via your eLake.io account. Processing may take 3–7 business days from receipt.

If you decline a revised Offer, eLake will return the item free of charge—unless the item is locked, misrepresented, or reported as stolen. Return shipping fees apply in such cases.

All sales are final once the payment has been issued. No refunds, reversals, or exchanges will be accepted after this point.

All Products sent to eLake must comply with all applicable U.S. and Michigan laws. You agree not to ship prohibited or restricted items, including devices originating from sanctioned countries.

eLake reserves the right to adjust Offers due to pricing errors or misidentified devices. If the adjustment occurs after you’ve shipped the item, a revised Offer will be issued for your approval.

Your use of eLake’s Services and Website is also subject to our Privacy Policy.

By using our Services, you consent to receive electronic communications from us, including Offers, account notices, and transaction updates. You are responsible for ensuring your email is functioning and not blocking messages from eLake.

We do not guarantee continuous, error-free operation of the Website. Access may be interrupted for updates, outages, or maintenance.

We disclaim all warranties, express or implied. The Website and Services are provided “as is,” “as available,” and with “all faults.” We do not guarantee that Offers will meet your expectations.

In no event shall eLake’s liability exceed the greater of (i) $50 or (ii) the value of the item sold to us. We are not liable for incidental, indirect, or consequential damages.

You agree to indemnify and hold harmless eLake, its employees, officers, and affiliates from all claims arising out of your violation of this Agreement.

This Agreement shall be governed by the laws of the State of Michigan. Any disputes shall be resolved through binding arbitration in Detroit, MI under the American Arbitration Association (AAA).

We reserve the right to modify or update these Terms at any time. Your continued use of eLake.io constitutes your acceptance of the updated Terms.

If any provision of this Agreement is found unenforceable, the remaining terms shall remain in full force and effect.
